These decisions mark a significant evolution in French labor law concerning <strong data-start=\"579\" data-end=\"593\">paid leave<\/strong> and <strong data-start=\"598\" data-end=\"622\">overtime calculation<\/strong>, and reflect the Court\u2019s intent to align national law with European law.<\/p>\n<h2 data-start=\"702\" data-end=\"773\">1. Paid Leave and Sick Leave: Suspension of Leave Entitlement<\/h2>\n<p data-start=\"774\" data-end=\"819\">(<em data-start=\"775\" data-end=\"818\">Cass. soc., Sept. 10, 2025, No. 23-22.732<\/em>)<\/p>\n<p data-start=\"821\" data-end=\"1037\">The Court ruled that when an employee falls ill during a period of paid leave, the sick leave suspends the paid leave. In practical terms, this means the employee retains the right to use those paid leave days later.<\/p>\n<p data-start=\"1039\" data-end=\"1175\">The Court\u2019s objective is clear: to distinguish between paid leave (meant for rest and leisure) and sick leave (intended for recovery).<\/p>\n<p data-start=\"1177\" data-end=\"1368\">This decision applies Article L. 3141-3 of the French Labor Code in light of <strong data-start=\"1254\" data-end=\"1294\">Article 7(1) of Directive 2003\/88\/EC<\/strong>, consistent with the <strong data-start=\"1316\" data-end=\"1335\">CJEU\u2019s case law<\/strong> (<em data-start=\"1337\" data-end=\"1366\">Schultz-Hoff, Pereda, ANGED<\/em>).<\/p>\n<p data-start=\"1370\" data-end=\"1452\">Note: The suspension is subject to the employee submitting proof of sick leave.<\/p>\n<h2 data-start=\"1459\" data-end=\"1515\"><strong>2. <\/strong>Paid Leave Counts Toward Overtime Threshold<\/h2>\n<p data-start=\"1516\" data-end=\"1561\">(<em data-start=\"1517\" data-end=\"1560\">Cass. soc., Sept. 10, 2025, No. 23-14.455<\/em>)<\/p>\n<p data-start=\"1563\" data-end=\"1669\">In a second ruling on the same day, the Court updated its stance on how <strong data-start=\"1635\" data-end=\"1653\">overtime hours<\/strong> are calculated.<\/p>\n<p data-start=\"1671\" data-end=\"1870\">From now on, for employees whose working time is calculated <strong data-start=\"1731\" data-end=\"1741\">weekly<\/strong>, <strong data-start=\"1743\" data-end=\"1804\">paid leave days must be considered as actual working time<\/strong> when determining whether the 35-hour threshold has been exceeded.<\/p>\n<p data-start=\"1872\" data-end=\"2101\">Once again, the Court aligns with EU law (<em data-start=\"1914\" data-end=\"1936\">Directive 2003\/88\/EC<\/em>, <strong data-start=\"1938\" data-end=\"1995\">Article 31(2) of the EU Charter of Fundamental Rights<\/strong>), which holds that an employee should not lose financial benefits for exercising the right to paid leave.<\/p>\n<p data-start=\"2103\" data-end=\"2312\"><strong data-start=\"2106\" data-end=\"2117\">Impact:<\/strong> Paid leave days count toward the overtime threshold. An employee can take a day off and still receive overtime pay if the total working time (including paid leave) exceeds 35 hours in that week.<\/p>\n<h2>A European Approach to French Labor Law<\/h2>\n<p data-start=\"2371\" data-end=\"2599\">These two decisions clearly reflect a <strong data-start=\"2409\" data-end=\"2437\">European-driven approach<\/strong> adopted by the <em data-start=\"2453\" data-end=\"2472\">Cour de cassation<\/em>. The Court is no longer merely applying transposed EU directives but is <strong data-start=\"2545\" data-end=\"2598\">directly enforcing European law and CJEU case law<\/strong>.<\/p>\n<p data-start=\"2601\" data-end=\"2704\">The upside? Better alignment between French and EU labor standards, promoting <strong data-start=\"2679\" data-end=\"2703\">social harmonization<\/strong>.<\/p>\n<p data-start=\"2706\" data-end=\"2850\">The downside?
